Who we are

Information we collect

We may collect information you provide directly, including your name, email address, phone number, business information, diagnostic result, scheduling preferences, and any details you choose to include with a call or resource request.

Before the Station Finder begins, we ask for your contact details and offer separate, optional choices for Station resource texts and appointment texts. Your details and choices are sent to our system only after you finish the quiz. We use your answers to calculate a Station, then send your contact details, Station result, resource-text choice, and submission details to our customer relationship management provider to record the request and deliver the matching worksheet by email. The result is revealed after that request succeeds.

If you later request a Station Clarity Call, we send the details you entered before the quiz, your Station result, selected time, any note you provide, and your scheduling-email and appointment-text choices to GoHighLevel or LeadConnector. We use this information to create and review the call request, keep a record of your communication choices, and send the scheduling email you requested.

We may also receive basic technical information needed to operate and protect the website, such as browser type, device information, IP address, and activity logs.

How we use information

• To deliver diagnostic results, requested resources, and scheduling services.
• To review and respond to Station Clarity Call requests.
• To send the Station worksheet you requested by email and, if you separately opt in, marketing texts about Station resource updates after that text program is activated.
• To operate, secure, troubleshoot, and improve The Pendulum System.
• To comply with legal obligations and enforce our terms.

Cookies and tracking

Our website currently does not use analytics or advertising cookies. Cloudflare, which helps deliver and protect the site, sets a security cookie called __cf_bm to help distinguish automated traffic from people using the site. Cloudflare may process your IP address, browser and device information, and request activity for site security and operation. This cookie does not enroll you in text messages and is not used by us for targeted advertising. We will update this policy before adding analytics or advertising tracking to the website.

Email and text messages

Providing a mobile number in the Station Finder form does not enroll you in texts. The worksheet is sent by email whether or not you select the separate, optional SMS checkbox. If you select it, Pendulum Systems, LLC may send marketing texts about Station resource availability and related Pendulum System resource updates after that program is activated. This choice does not authorize appointment texts.

The separate, optional appointment-text choice appears before the quiz. If you select it and later request a Station Clarity Call, appointment texts may include follow-up to arrange the call, scheduling confirmations, changes, and reminders after that program is activated. The time-request step separately asks for scheduling email consent. Appointment texting is not active. Requesting a call, providing a phone number, or choosing Station resource texts does not enroll you in appointment texts.

Text-message frequency may vary based on your choices and booked appointments. Message and data rates may apply. Reply STOP to opt out of texts or HELP for help. You may also contact us at nigel@nigelelkan.com. SMS consent is not required to receive your result or worksheet, request a call, or make a purchase.

We do not sell personal information. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Service providers and disclosures

We may use service providers for website hosting, customer relationship management, forms, calendar scheduling, email, text messaging, video meetings, security, and related operations. Current launch tools include GoHighLevel or LeadConnector and Google Workspace services such as Calendar and Meet.

We may disclose information when required by law, to protect rights or safety, or as part of a business transaction subject to appropriate safeguards.

Retention, security, and your choices

We retain information only as long as reasonably necessary for the purposes described above, our business records, dispute resolution, and legal obligations. We use reasonable administrative and technical safeguards, but no online system can be guaranteed completely secure.

You may ask to access, correct, or delete information you have provided, or withdraw a communication preference, by emailing nigel@nigelelkan.com. We may need to keep limited information where required by law or for legitimate business records.

Children and policy changes

The Pendulum System is intended for business owners and is not directed to children under 13. We may revise this policy as the service and its tools change. The date above will identify the latest version.
